This website is owned and operated by Mind Wellbeing Therapy, with offices at
24 Wellington Road, Middlesex, HA5 4NL, London.
These Terms set forth the terms and conditions under which you may use the Site and services as offered by us relating to the sale and purchase of Products on the Site.
Services/products are offered for sale/purchase or information purposes only.
To use our website and/or receive our services, you must be at least 18 years of age and possess the legal authority, right and freedom to enter into these Terms as a binding agreement. You are not allowed to use this website and/or receive services if doing so is prohibited in your country or under any applicable law or regulation. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms.
Please take time to read these terms and conditions carefully.
Your use of the Site and the purchase of any Products or Services on this Site will be subject to these terms and conditions.
From time to time, access to the Site or pages linked to the Site may be interrupted due to the suspension of the Site's operation for repair or maintenance work.

1. Definitions

In these terms and conditions, the following definitions will be used and applied:
1.1 "The Site" means the www.mindwellbeingtherapy.com website and all other sites operated by Mind Wellbeing Therapy whether through that URL or otherwise.
1.2 “The Company” or “We” or "the Therapist" will be used interchangeably and means Mind Wellbeing Therapy - Maggie Greenfield with office address at 24 Wellington Road, Middlesex, HA5 4NL.
1.3 “You”, or “Client”, or "Member" will be used interchangeably and means a user of services/products provided by the Company.
1.4 "Services" means any information, video recording and streaming, photos, articles, statements and services ordered and/or provided by the Company through or via the Site. Any electronic information supplied to you by the Company will constitute part of the Service, not a Product, and any cancellation rights will apply and be interpreted accordingly.
1.5 "Products" means any products/services offered for sale to be purchased or offered as a free offer to you on the Site.
1.6 This Agreement sets forth legally binding terms for using the Site. By using the Site, you agree to be bound by this Agreement as a "Visitor" (browsing the Site) or as a "Client" or a "Member".
1.7 We reserve the right to modify these terms occasionally at our sole discretion. Therefore, you should review these pages periodically. If we change the Terms in a major manner, we will notify you that material changes have been made to the Terms by posting a notification message on the Site. Your continued use of the Site or our services after any such change constitutes your acceptance of the new Terms. You agree that the Company may subcontract the performance of any of its obligations or may assign these terms and conditions or any of its rights or obligations without giving you notice.
1.8 If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the service immediately.

2. Disclaimer

Please be aware that therapy is not a substitute for medical or specialist mental health treatment/attention and are not intended to diagnose or treat any physical or mental condition. No content, any information contained on the Site, provided through the Site or provided by email or in any manner whatsoever should be construed as medical and/or health advice, medical diagnosis or treatment.
Please be sure to seek relevant professional medical help if you feel it is appropriate for you.​​

3. Cancellations, Refunds and Rescheduling ​

3.1. Refunds
All Zoom appointment sessions have to be paid via a bank transfer or via the Site in full upon booking the appointment during the Free Consultation or the latest 48 hours after receiving the appointment confirmation email.

A single session - the cost of a single session minus a £25 administration fee will be refunded via the original purchase method, but only if you provide a minimum of 48-hour notice. Failure to provide a cancellation period or less than 48-hour notice will result in no refund.

To reschedule, a minimum of 48-hour notice is required. If no notice or less than 48-hour notice is given, it may result in no refund and no rescheduling. However, this is reviewed on an individual basis.

The session package - Sessions already taken will be charged at the full amount. The remainder of the prepaid amount will be refunded through the original purchase method, minus a £25 administration fee, but only if you provide a minimum of 48-hour notice. Failure to provide a cancellation period or less than 48-hour notice will result in no refund.​ A refund for any remaining sessions will be provided if a minimum of 48-hour cancellation period is provided.

The session packages are valid for a maximum of 12 weeks (depending on the number of sessions booked) from the receipt of the payment.

Missed appointment - A full amount of the session will be charged if a minimum of 48-hour notice is not given.

Early arrival - please wait for your appointment before joining the meeting; an early arrival might interfere with a preceding client’s therapy or interrupt the therapist’s recovery and preparation time. If you are late for an appointment, your therapist will attempt to offer the best possible service within the time left. However, the appointment will end at the agreed time with no adjustment to the fee.

Maggie Greenfield reserves the right to cancel or postpone an appointment if circumstances are beyond her control. A full refund will be issued if the Therapist can not continue with the treatment.
3.2. Non-arrival
When appointments are missed, a full amount of the session will be charged if a minimum of 48-hour notice is not given. A refund is applicable only if a minimum of 48-hour cancellation notice is given, minus a £25 administration fee.
3.3. Late or early arrival
If you arrive early, please wait for your appointment before calling; an early arrival might interfere with a preceding client’s therapy or interrupt the therapist’s recovery and preparation time. If you are late for an appointment, your therapist will attempt to offer the best possible service within the time left. However, the appointment will end at the agreed time with no adjustment to the fee.
3.4 Mind Wellbeing Therapy - Maggie Greenfield reserves the right to cancel or postpone an appointment if there are circumstances beyond our control. A full refund will be issued if the Therapist can not continue with the treatment.

4. Confidentiality
4.1 All communication taking place during therapy is confidential, subject to certain provisions; therapists are not at liberty to withhold information from the police.
4.2 Your therapist is required to inform the authorities if there is a possibility that you or a member of the public is at risk. It is considered to be confidential if an NHS professional requires information to be able to help you.
4.3 Parts of your conversation may be referred to during supervision, a requirement for registered therapists, although your name or any identifying details would not be disclosed.
5. GDPR/Data Protection Act
5.1 Therapists are required to keep your details on file for seven years. They may be kept on hard copy or computer; this information will be kept secure, as per NCH guidelines on client security. The client is entitled to a copy of these details whilst kept by the therapist; in accordance with the Data Protection Act/GDPR, there is a charge of £20 per copy for this service.
6. Guarantees
6.1 There are several complex factors influencing the success of individual therapy, and whilst benefits are typically observed in the majority of cases, there can be no guarantees of success or cure in relation to a condition or its treatment.
6.2 Maggie Greenfield reserves the right to cancel or postpone an appointment if there are circumstances beyond our control. A full refund will be issued if the Therapist can not continue with the treatment.

7. Use of Personal information

7.1 The way we use your personal information is governed by the Company's Privacy & Cookies Policy, which forms part of these Terms and Conditions and it can be found here.
5. Testimonials
​
5.1 The Site may contain testimonials from users of our products and/or services. These testimonials reflect the real-life experiences and opinions of such users. However, the experiences are personal to those particular users and may not necessarily be representative of all users of our products and/or services. We do not claim, and you should not assume, that all users will have the same experiences.
The testimonials on the Site are submitted in various forms, such as text, audio and/or video, and are reviewed by us before being posted. Some testimonials may have been shortened for the sake of brevity, where the full testimonial contained extraneous information not relevant to the general public.
The views and opinions contained in the testimonials belong solely to the individual user and do not reflect our views and opinions.
We are not affiliated with users who provide testimonials, and users are not paid or otherwise compensated for their testimonials.
The testimonials on the Site are not intended, nor should they be construed, as claims that our products and/or services can be used to diagnose, treat, mitigate, cure, prevent or otherwise be used for any disease or medical condition. No testimonials have been clinically proven or evaluated.
6. Use of the Site
6.1 The Service and all materials therein or transferred thereby, including, without limitation, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Maggie Greenfield, the Company or its partners. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, sell, transmit, distribute or create derivative works thereof.

6.2 The Site may include a Member community. All Members that join a community have a public profile that is publicly visible to other members of the community, community member’s public activity (such as their posts or comments) will be visible to other members of the website.
Any Member of the website can opt in and exit the community, and upon doing so, such a user’s profile will not be publicly visible. In such an event, the Member will not be able to use the community features (e.g. liking, commenting or writing posts).
Based on the above, you accept and agree that by uploading any content (including, but not limited to, designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text and literary works) through any means to the website, you confirm that you own all the relevant rights or received the appropriate license to upload/transfer/send the content.
You agree and consent that the uploaded/transferred content may be publicly displayed on the website. Therefore, you agree you must not upload and/or share any material of obscene or pornographic, threatening, menacing, racist, offensive, or defamatory nature. You agree not to harass, stalk, threaten or otherwise violate the rights of others, to misrepresent your identity or status, to hack into this Site or any other related computer system or to deliver viruses of damaging nature to the Site.

6.3 We do not accept the obligation to monitor the use of the Site. However, the Company reserves the right to do so in order to fully cooperate with law enforcement and other relevant authorities.
7. Promotional emails and content

7.1 You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.
If you sign up for our newsletter, please know that we will never share your personal information with any third party without your permission.
8. Product, services, prices

8.1 When purchasing a service/product, you agree that you are responsible for reading the full description before making a commitment to buy it; you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

8.2 The prices we charge for using our services and/or products are listed on the website and are correct at the time of purchase or booking. We reserve the right to make changes to our prices or the structure of our courses/memberships at any time and without notice. All prices include 20% VAT.
8.3 The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged to your payment method at the time of purchase.

8.4 Mindfulness / Meditation 7 Relaxation Group Classes ONLY - To the best of our abilities, we ensure that our class schedule on the website is up to date. In certain instances that are out of our control, we reserve the right to make last-minute changes. From time to time, classes may be cancelled due to illness or other unforeseen events. In the event of a cancellation, we will notify you via email and/or make reasonable efforts to contact you, and the option to reschedule or refund will be offered.
8.5 All our classes and memberships are available to purchase online only. All payments must be made online by debit or credit card prior to making a class booking.
8.7 No contract will exist in relation to the Services or Products until we have confirmed to you by email the details of your order. Acceptance will be deemed complete and will be deemed, for all purposes, to have been effectively communicated to you when you are able to access the confirmatory email. This will be without prejudice to your right to cancel as per our refund and cancellation policy and to your statutory rights as a consumer.
8.8 After a purchase and class booking, we will share the receipt with you via email and any details of the class that was booked, including location, date and time of the class, confirmation of submitted liability waiver and acceptance of terms & conditions.

10. Preference of law and dispute resolution
10.1 These terms and conditions shall be governed and interpreted in accordance with English law, and you consent to the non-exclusive jurisdiction of the English courts.
10.2 This Site and the Company are located in England, and in case of any International orders, subscriptions or contracts, this Agreement shall be construed as being performed in England.

1. Liability and Health & Safety Statements for Mindfulness & Relaxation Group Classes ONLY
​
1.1 Before using any of the Services and Products, it is your responsibility to determine that you are fit and well and that the Services and Products are suitable for you. You are responsible for your own safety.
In any practice, there are risks and benefits associated with participation. While it is difficult to anticipate all of these risks, we are obligated to alert participants that such risks are possible.
Relaxation classes can include but are not limited to practice: meditation, mindfulness, yoga Nidra, energy healing or any form of mindful movement. As with any physical activity, the risk of injury is always present and cannot be entirely eliminated. In all physical activity during the class or as a part of home practice, it is important that you take care of yourself. Please make sure to stop any exercise where you feel pain. Respect the boundaries of your physical capabilities and do not go beyond them but rather either stop completely and discuss the issue with your health professional or adjust the practice to fit your level of comfort.
Please be aware that relaxation therapy, mindfulness, and meditation practices are not substitutes for medical or mental health treatment/attention and are not intended to examine, diagnose or treat any physical or mental condition. No content, any information contained on the Site, provided through the Site or provided by email or in any manner whatsoever should be construed as medical and/or health advice, medical diagnosis or treatment.

Relaxation therapy and its components, as listed above, may not be safe under certain medical conditions. If you are working with a health professional, you are encouraged to discuss with them the advisability of incorporating relaxation practice and its components before engaging in any services offered by us.
Working with relaxation practice can heighten certain feelings like but not limited to: sadness, anger, fear and anxiety. These feelings may be more apparent because you are being encouraged to pay attention to them. If you find yourself struggling with your experience during practice, you should discontinue the practice and do what you feel is right for you in order to care for yourself at that moment and/or discuss it with your medical professional where appropriate.

1.2 Relaxation therapy may produce a deep state of relaxation. Please ensure you are fully cognitive before undertaking any tasks requiring working with machinery or driving.
It is the Member’s responsibility to ensure that they are medically and mentally capable of taking a class/activity. All classes/activities are undertaken at participants' own risk.
1.3 Members are required to read and confirm understanding of the liability waiver, which is required to be signed and submitted by the participant of a class/service at the point of booking the class/service or/and purchasing relevant products. Failing to do so may result in cancellation of booking without the right to refund.
1.4 To the maximum extent permitted by applicable law, in no event shall Maggie Greenfield, the Company and/or authorised by the Company persons be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service or relying on or acting on any information provided on the Site or through electronic means.
To the maximum extent permitted by applicable law, Maggie Greenfield, the Company, and any authorised by the Company persons assume no liability or responsibility for any errors, mistakes, or inaccuracies of content; personal injury or property damage of any nature whatsoever, resulting from your access to or use of our service; and any unauthorised access to or use of our secure servers and/or any and all personal information stored therein.
1.5 You agree to indemnify and hold Maggie Greenfield and/or the Company harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees) made against them by any third party due to, or arising out of, or in connection with your use of the Site or any of the services offered on the Site.
1.6 The Site may include links to external sites, e-mails and other relevant pages to provide information and services that may be of use or interest to you. The Company is not responsible for the content of these sites and pages or for anything provided by them, and you assume full responsibility for engaging with those sites, information, advice, or otherwise provided by third-party websites.
The Company is not liable for failure to comply with these terms and conditions in an event beyond its reasonable control.
2. Membership Subscription Terms and Conditions
2.1 All purchased memberships and individual classes have expiry dates that will be made clear at the time of purchase and will expire at a specific date if not used.
The monthly Membership allows the participant to book a specific number of classes (as specified individually in each membership package) during each subscription cycle.
Membership with running time ‘until cancelled’ can be cancelled at any time during the subscription period. Membership is paid in advance therefore the cancellation will take place from the next payment cycle.
If you wish to cancel, please allow at least seven days' notice for the cancellation to be confirmed. To cancel, please log in to your Member Account area on the Site.
2.2 Subscription to membership Services may be available for varying commitment periods (e.g. one month, three months or ongoing basis until cancelled), and it will be charged as a one-off payment for a single service/product/one-month membership or monthly until cancelled.
2.3 If you choose to pay a monthly subscription with no commitment period, the monthly charges will be collected by debit/credit card until we or you cancel your subscription by accessing your Members Account page on the Site.
2.4 If you choose a subscription with a fixed commitment period (e.g. three months), at the end of that period, your subscription will automatically renew until you cancel it by accessing your Members Account page on the Site.
2.5 We will collect all monthly fees due from the debit/credit card you provide upon registration. We may suspend or cancel any Services, including your subscription, in the event of problems with the debit/credit card.
2.6 Subject to your cooling off right and your statutory consumer rights, membership subscription fees are non-refundable. Subscriptions with fixed commitment periods may not be cancelled until all the monthly payments have been made. Any attempt to cancel such payment may result in the Company deducting the balance of payments due immediately.
2.7 If your subscription begins with any promotional/free period, you will be automatically charged for the subscription rates to which you agreed on the expiry of that promotional period unless you cancel your account during the promotional period. This can be done on your Member’s Account page on the Site.
2.8 The Company may terminate the Service immediately in the event you breach any of the terms and conditions or if you are late in paying or do not pay any sums due (including if the credit/debit card you use is not valid or does not work for another reason).
2.9 Any corporate memberships are only available to employees/members of the specified organisation (or other parties if the offer is specifically extended to such parties). Any attempt to subscribe to such a plan without entitlement to do so may result in the Company deducting/requesting the balance of payments due immediately.
2.10 Purchases of individual classes, memberships and bookings are non-transferable. Therefore, members can not transfer any purchases to another person or permit them to be used by anyone other than themselves. If you purchase a membership, we encourage you to book into the class you want to attend to avoid disappointment, as there is a limit on the number of participants.
3. Cancellation and Refunds of Memberships ONLY.
3.1 You may cancel Services, including any subscription, within seven days after the day of ordering by cancelling through your Members Account page on the Site.
Any refund can only be made to the original debit/credit cards used at the time of purchase.
This right will cease once you use your password to log on to the members-only part of the Site or to access the Services ordered (or subscribed for) for the first time during that 7-day period.
3.2 Refunds for unused classes are not available - we encourage you to make up missed classes before the end of the term of your subscription. Refunds for other reasons are available in very rare circumstances and are made at the company's discretion. Please contact us to discuss.
3.3 Refunds for services/classes attended are non-refundable under no circumstances.
3.4 We operate a strict 2-hour cancellation policy for all the classes. If you fail to attend a class, it will be deducted from the membership pack, and the credit will be lost and non-refundable.
3.5 All cancellations or changes must be communicated through Members' Accounts on the Site only.
We can not offer a refund or date change if we are not informed 2 hours in advance of the class taking place.
3.6 All classes begin and are locked exactly at the scheduled time, and no latecomers will be admitted to the class. Latecomers will not be admitted to the class and will lose the credit from the membership pack or single class access.
3.7 We reserve the right to cancel classes whether we encounter any unforeseen circumstances. We will notify all guests of the cancellation as soon as possible via the email provided during registration and will offer the option to reschedule or refund.
